Terms of Service

These Terms of Service ("Terms") govern your use of this website and the online interior design services (the "Services") provided by OCEANWAVE PUPIL ART LLC, a California limited liability company ("Company", "we", "us" or "our"), operating under the brand name Spixivo at spixivo.com. By using the website or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

1. Services

We provide remote interior design services. Depending on your project, deliverables may include a space plan, 3D renderings, a materials and furnishing list, and reference drawings. The exact scope is confirmed between you and your designer after payment.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order.

3. Quotes, pricing and payment

• The design fee is calculated from the total area you enter: US$0.70 per square metre (approximately US$0.065 per square foot). Room counts, kitchen type and number of floors are used as design requirements and do not change the price.
• All prices are in U.S. dollars. Applicable taxes, if any, will be shown before payment.
• Payment is due in full when you place your order. Payments are processed by a third-party payment processor; we do not store your full card details.
• If the actual area of your space differs materially from the area you entered, we may ask you to pay the difference or offer to adjust the scope before work continues.

4. Designer contact and timeline

After a successful payment, a designer will contact you by email within 8 hours at the email address you provided. Please make sure it is correct and check your spam folder. Delivery timelines for design materials are agreed with your designer and depend on project size and how quickly you provide the information we need. We are not responsible for delays caused by an incorrect email address or by missing information.

5. Your responsibilities

• Provide accurate measurements, floor plans, photos and other information about your space.
• Make sure you have the right to share any materials you send us.
• Respond to your designer's questions in a reasonable time.

6. Revisions

Your order includes reasonable revisions within the agreed scope. Changes that substantially alter the scope, such as a new layout, additional rooms or a larger area, may require an additional fee, which we will quote to you before starting.

7. Nature of the design work

Our deliverables are design concepts and reference materials only. They are not architectural, structural, electrical, plumbing or engineering drawings and are not intended for permit applications. Before any construction or installation, you must verify all dimensions and have the work reviewed and carried out by appropriately licensed professionals in compliance with local building codes. Colours and materials in renderings may differ from real products.

8. Intellectual property

We retain copyright in all design materials we create. Once you have paid in full, we grant you a non-exclusive, non-transferable license to use the deliverables for your own project at the address you specified. You may not resell or republish the deliverables commercially without our written consent. We may display anonymised images of the work in our portfolio unless you ask us in writing not to.

9. Third-party products

Any furniture, materials or suppliers we recommend are provided for your convenience. We do not sell those products and are not responsible for their availability, price, quality or delivery.

10. Disclaimer of warranties

Except as expressly stated in these Terms, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or data. Our total liability arising out of or relating to the Services will not exceed the amount you paid for the order giving rise to the claim.

12. Cancellation and refunds

Cancellations and refunds are governed by our Refund Policy.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Before filing a claim, you agree to contact us first and try to resolve the dispute informally for at least 30 days.

14. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place an order applies to that order. The "Last updated" date shows when the Terms last changed.

1. 服务内容

我们提供远程室内设计服务。根据项目不同，交付内容可能包括平面布局、3D 效果图、材料与软装清单以及参考图纸。具体范围在付款后由您与设计师确认。

2. 使用资格

下单者须年满 18 周岁，并具有订立有效合同的能力。

3. 报价、价格与付款

• 设计费按您填写的总面积计算：每平方米 0.70 美元（约每平方英尺 0.065 美元）。房间数量、厨房类型与楼层仅作为设计需求，不影响价格。
• 所有价格均以美元计。如需缴纳相关税费，将在付款前显示。
• 下单时须一次性全额付款。付款由第三方支付机构处理，我们不保存您的完整银行卡信息。
• 如实际面积与填写面积存在明显差异，我们可能要求补足差价，或在继续工作前与您协商调整服务范围。

4. 设计师联系与时间安排

付款成功后，设计师将在 8 小时内 通过您填写的邮箱与您联系，请确保邮箱正确并留意垃圾邮件文件夹。设计交付时间由您与设计师商定，取决于项目规模及您提供所需信息的速度。因邮箱填写错误或信息缺失造成的延误，我们不承担责任。

5. 您的责任

• 提供准确的尺寸、户型图、照片等空间信息；
• 确保您有权分享发送给我们的资料；
• 在合理时间内回复设计师的问题。

6. 修改

订单包含约定范围内的合理修改。若变更实质性改变了服务范围（例如全新布局、增加房间或扩大面积），可能需另行收费，我们会在开始前向您报价。

7. 设计成果的性质

我们交付的是设计方案与参考资料，并非建筑、结构、电气、给排水或工程图纸，也不可用于报建申请。施工或安装前，您必须自行核实所有尺寸，并由具备相应资质的专业人员按照当地建筑规范审核与施工。效果图中的颜色与材质可能与实际产品存在差异。

8. 知识产权

我们保留所创作设计成果的著作权。在您全额付款后，我们授予您非独占、不可转让的许可，用于您指定地址的自用项目。未经我们书面同意，您不得将设计成果转售或用于商业发布。除非您书面要求，我们可在作品集中展示经匿名处理的项目图片。

9. 第三方产品

我们推荐的家具、材料或供应商仅供参考。我们不销售这些产品，也不对其供货、价格、质量或配送负责。

10. 免责声明

除本条款明确规定外，本服务按“现状”及“现有”基础提供，不作任何明示或默示的保证，包括适销性、特定用途适用性及不侵权的默示保证。

11. 责任限制

在法律允许的最大范围内，本公司不对任何间接、附带、特殊、后果性或惩罚性损害，或任何利润、数据损失承担责任。我们因本服务产生或与之相关的全部责任，不超过您就引起索赔的订单所支付的金额。

12. 取消与退款

取消与退款适用我们的退款政策。

13. 适用法律与争议解决

本条款受美国加利福尼亚州法律管辖（不适用其冲突法规则）。任何争议均由位于加利福尼亚州洛杉矶县的州法院或联邦法院专属管辖，您同意接受其管辖。提起诉讼前，您同意先与我们联系，并以至少 30 天时间尝试非正式协商解决。

14. 条款变更

我们可能不时更新本条款。您下单时有效的版本适用于该订单。“最后更新”日期表示本条款最近一次变更的时间。

This Privacy Policy explains how OCEANWAVE PUPIL ART LLC ("we", "us") collects, uses and shares personal information when you visit this website or use our Services. It also describes the rights you have, including under the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, "CCPA").

1. Information we collect

• Information you give us: your email address, project details (number of rooms, kitchen type, floors, total area), notes, and any floor plans, photos or messages you send your designer.
• Payment information: payments are handled by our third-party payment processor. We receive confirmation of payment, the amount and limited details such as the card type and last four digits. We never receive or store your full card number.
• Automatically collected information: basic technical data such as browser type, device, IP address and pages visited, collected through server logs.
• Local storage: we store your language preference in your browser. We do not use advertising cookies.

2. How we use your information

• To provide the Services, including having a designer contact you and delivering your design;
• To process payments and refunds and keep business and tax records;
• To answer your questions and send service-related messages;
• To keep the website secure, prevent fraud and improve our Services;
• To comply with legal obligations.

We do not send marketing emails unless you opt in, and you can unsubscribe at any time.

3. How we share information

We share personal information only with:

• Service providers that help us operate, such as payment processors, email and hosting providers, under contracts that limit their use of your data;
• Designers working on your project;
• Authorities, when required by law or to protect our rights;
• A successor entity in the event of a merger, acquisition or sale of assets.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

4. Data retention

We keep project information for as long as needed to provide the Services and support you afterwards, and keep transaction records for as long as required by tax and accounting laws (generally up to 7 years). After that, we delete or anonymise the data.

5. Your California privacy rights

If you are a California resident, you have the right to:

• Know what personal information we collect, use and disclose;
• Access and receive a copy of your personal information;
• Request correction of inaccurate information;
• Request deletion of your personal information, subject to legal exceptions;
• Opt out of the sale or sharing of personal information (we do not sell or share it);
• Not be discriminated against for exercising these rights.

To make a request, email oceanpupil2026@outlook.com. We will verify your identity and respond within 45 days. You may use an authorized agent to make a request on your behalf. Residents of other places may also contact us to exercise the rights available under their local law.

6. Security

We use reasonable technical and organisational measures to protect your information, including encrypted (HTTPS) connections. No method of transmission or storage is completely secure, however.

7. Children

Our Services are not directed to children under 16, and we do not knowingly collect their personal information. If you believe a child has given us information, please contact us so we can delete it.

8. International users

We are based in the United States. If you use the Services from outside the U.S., your information will be transferred to and processed in the U.S.

9. Changes

We may update this Privacy Policy. We will post the new version on this page and update the "Last updated" date.

2. 信息用途

• 提供本服务，包括安排设计师与您联系并交付设计；
• 处理付款与退款，保存业务和税务记录；
• 回复您的问题，发送与服务相关的通知；
• 保障网站安全、防范欺诈并改进服务；
• 履行法律义务。

除非您主动订阅，我们不会发送营销邮件；您可随时退订。

3. 信息分享

我们仅在以下情况分享个人信息：

• 协助我们运营的服务商，如支付、邮件和托管服务商，并以合同限制其对数据的使用；
• 负责您项目的设计师；
• 法律要求或为保护我们的合法权利时，向有关机关提供；
• 发生合并、收购或资产出售时，向承继方提供。

我们不出售您的个人信息，也不将其用于跨情境行为广告。

4. 数据保留

项目信息在提供服务及后续支持所需的期间内保留；交易记录按税务与会计法规要求保留（一般不超过 7 年）。期满后，我们会删除数据或进行匿名化处理。

5. 加州居民的隐私权利

如果您是加州居民，您有权：

• 知悉我们收集、使用和披露哪些个人信息；
• 访问并获取您的个人信息副本；
• 要求更正不准确的信息；
• 要求删除您的个人信息（法律规定的例外情形除外）；
• 选择退出个人信息的出售或分享（我们不出售也不分享）；
• 不因行使上述权利而受到歧视。

Refund Policy

We want you to be happy with your design. This policy explains when you can cancel your order and receive a refund.

1. Full refund

• You cancel before your designer has started work on your project; or
• We fail to contact you within 8 hours of payment and you cancel before work starts; or
• We are unable to provide the Services for your project.

2. Partial refund

If you cancel after work has started but before the design is delivered, we will refund the amount paid minus the value of the work already completed. This deduction will not exceed 50% of the order total.

3. No refund

• After the final design has been delivered;
• For changes of mind about style after the design direction has been confirmed by you;
• When the project cannot continue because you provided inaccurate information or did not respond for 30 days or more.

4. Dissatisfaction with the design

If you are not satisfied, please tell your designer first. We will revise the design within the agreed scope. If we still cannot meet the agreed scope, you may request a refund under section 2.

5. How to request a refund

Email oceanpupil2026@outlook.com with your order number and the reason for your request. We will reply within 2 business days. Approved refunds are issued to your original payment method within 5–10 business days; when the funds appear depends on your bank or card issuer.

6. Chargebacks

Please contact us before disputing a charge with your bank. We will try to resolve the issue quickly and fairly.

我们希望您对设计满意。本政策说明您何时可以取消订单并获得退款。本政策以英文版为准，中文版仅供参考。

1. 全额退款

• 您在设计师开始工作前取消订单；或
• 我们未在付款后 8 小时内与您联系，且您在工作开始前取消订单；或
• 我们无法为您的项目提供服务。

2. 部分退款

如您在工作开始后、设计交付前取消订单，我们将退还已付金额扣除已完成工作价值后的余额，扣除部分不超过订单总额的 50%。

3. 不予退款

• 最终设计已交付后；
• 您已确认设计方向后又改变风格偏好；
• 因您提供的信息不准确，或连续 30 天及以上未回复，导致项目无法继续。

4. 对设计不满意

如对设计不满意，请先告知设计师，我们会在约定范围内修改。如修改后仍无法达到约定范围，您可按第 2 条申请退款。

5. 如何申请退款

请发送邮件至 oceanpupil2026@outlook.com，注明订单号和退款原因。我们会在 2 个工作日内回复。退款获批后，将在 5–10 个工作日内原路退回；到账时间取决于您的银行或发卡机构。

6. 拒付

向银行发起拒付前，请先联系我们，我们会尽快公平地解决问题。
